ON THE SEA INTERIORS
Effective Date: June 20, 2026
Client Acknowledgements
By moving forward with payment for the items listed on your order, you acknowledge that you have had the opportunity to review and select the listed items, approve the furnishings and pricing (including but not limited to price of merchandise, taxes, shipping, receiving, and delivery fees as applicable), and agree to all the Terms & Conditions of Sale by On The Sea Interiors (“On The Sea”).
TERMS OF PAYMENT
Full payment is required at the time of purchase for all items, including in-stock, custom, made-to-order, and one-of-a-kind items. Full receipt of funds is a condition precedent to On The Sea processing any orders. Once funds are received in full, On The Sea shall proceed with processing the items on the order with reasonable promptness.
Advertised Pricing
We work hard to keep pricing accurate on our website, but occasionally our suppliers adjust their costs, which may affect the prices we display. If a price changes on an item you've recently ordered, we'll let you know right away before we process your order. On The Sea Interiors reserves the right to correct any pricing errors.
Order Processing & Lead Times
On The Sea shall endeavor to keep you reasonably informed regarding the progress of production, Estimated Time of Shipping (“ETS”), and Estimated Time of Arrival (“ETA”) as provided by our suppliers and manufacturers.
Lead times provided at the time of order are estimates only and may be subject to change due to supplier or manufacturing delays. Delivery dates and times are estimates and are not guaranteed. On The Sea is not responsible for any delays arising from suppliers, manufacturers, and/or delivery providers.
Pre-Delivery & Pickup Requirements
Customers are responsible for verifying that all purchased furnishings will fit through all necessary entryways, hallways, staircases, elevators, and lifts prior to the scheduled delivery and/or pickup. On The Sea is not liable for furnishings that cannot be successfully delivered due to spatial constraints or access limitations at the designated location.
Items Picked Up In Showroom ("In-Store")
Certain items may be eligible for local in-store pickup. You are welcome to pick up your purchase directly from our showroom. We recommend measuring your space and vehicle ahead of time.
Customers are responsible for bringing appropriate vehicles and assistance for transporting purchased items. All items must be inspected at the time of pickup. Once an item leaves our showroom, On The Sea is not responsible for damages that may occur during customer transport.
Shipping & White Glove Delivery
For Standard Curbside Deliveries
On The Sea will assist you in arranging delivery of your purchased furnishings. For items shipped via standard curbside delivery, you are responsible for receiving, inspecting, and storing items at a designated location. Please inspect all items within 24 hours of receipt for any damages or defects.
For deliveries requiring a signature, do not accept merchandise with damaged packaging unless it is opened, inspected upon arrival, and found to be free of damage. If merchandise is delivered damaged, you should reject it.
For all damaged and/or defective items received, please inform On The Sea in writing within 24 hours of receipt with photos of the damaged merchandise so we can proceed with the appropriate claims and returns procedures. On The Sea is not responsible for damaged or rejected items, but will endeavor to accommodate customers as much as reasonably possible.
For White Glove Deliveries
For items requiring White Glove Delivery, On The Sea will assist in scheduling and coordinating delivery of your purchased furnishings. Upon request, On The Sea may hold or delay delivery of purchased items for up to 30 days before holding fees apply. Holding fees are assessed on a case-by-case basis, and a written quote for additional charges will be provided.
On The Sea requires all White Glove Delivery Providers to maintain required insurance coverages associated with the services they provide. Should you choose to contract your own Receiving & Delivery (“R&D”) company, you must require that your R&D company maintain all required insurance coverages, including coverage for all furnishings and materials during handling, moving, storage, and installation.
If you acquire your own R&D company, you shall contract directly with them and provide On The Sea with the necessary contact information for coordination purposes. Your R&D company is responsible for inspecting all merchandise upon arrival at their facility and rejecting any damaged items, notifying both you and On The Sea in writing of any damages as soon as reasonably possible.
On The Sea is not responsible for the means, methods, techniques, or safety precautions of the White Glove Delivery Provider, or for any acts or omissions of any persons performing delivery or installation work, or for the failure of any of them to carry out their obligations.
For Decorating Projects designed by On The Sea ("Design Projects")
On a case-by-case basis, On The Sea may coordinate to be present onsite during certain White Glove Deliveries related to Design Projects. However, this does not create a duty or obligation for On The Sea to make multiple or exhaustive site visits for individual deliveries and/or installs.
Defects, Delays, & Damage Claims
On The Sea is not in control of or responsible for defects and/or delays caused by suppliers, manufacturers, shipping carriers, or R&D companies, or for their acts or performance associated with the products or services they provide (including but not limited to fabrication, lead times, processing, shipping, installation, or defects inherent to or damages arising from transit, delivery, and installation).
On The Sea will assist customers with processing claims for damaged items, provided all necessary proof and required documentation is submitted within the required timeframes. If your item arrives with defects or damages, please immediately:
- Document the damages and/or defects with clear photos.
- Contact On The Sea via email within 24 hours of receiving your order with a clear description of the issue(s) and documented damage(s).
Returns, Exchanges, & Cancellations
Customer requests to return or cancel a purchase will be assessed on a per-item basis and will be subject to On The Sea’s Suppliers & Manufacturers Return Policy. The Customer acknowledges that certain items are Custom and/or Final Sale and cannot be returned or exchanged. The Customer agrees that On The Sea is not responsible for any items that cannot be returned or exchanged.
The Customer agrees that certain items that qualify for Returns or Exchanges may be subject to a Restocking Fee and/or return shipping fees.The Customer shall be fully responsible for any and all Restocking & Shipping fees.
Should the Customer return any merchandise purchased at On The Sea for reasons other than damage, applicable returns should occur in their original packaging, and merchandise should be unused and undamaged. Should the original packaging not be suitable or not be available to return the merchandise, the Customer shall incur the cost to adequately ship the merchandise back to On The Sea in a manner as to avoid being damaged.
The Customer understands that the acceptable time frame for Returns & Exchanges varies between items, and agrees to inform On The Sea as soon as reasonably possible should they desire to return an item.
Eligible Items for Returns/Exchanges/Store Credit
We accept returns or exchanges on certain items purchased within 14 days of purchase, provided the item is in its original, unused condition with all original packaging and accompanied by proof of purchase. A restocking fee of up to 25% may apply. Please contact us to initiate a return before bringing the item back or shipping it to the showroom.
Custom, Special-Order, and One-Of-A-Kind Items
All custom, made-to-order, and one-of-a-kind items are final sale and cannot be returned, exchanged, or cancelled once the order has been processed. These pieces are made and/or sourced specifically for you.
Non-returnable/Non-Exchangeable Items
The following items cannot be returned or exchanged:
- Custom and special-order pieces
- One-of-a-kind and artisan items
- Floor models and “as-is” items
- Clearance and sale items
- Items showing signs of use, damage, or alteration
Return & Restocking Fees
Certain items that qualify for returns or exchanges may be subject to a restocking fee and/or return shipping fees. The customer is fully responsible for any and all restocking and shipping fees. Returns should occur in original packaging; if original packaging is not available, the customer is responsible for the cost of adequate return shipping to avoid damage.
Damages & Limitation of Liability
On The Sea is not liable for any damage, injury, or loss that occurs after the customer takes possession of the purchased item. It is the customer’s responsibility to ensure proper use, installation, placement, and care of all items in accordance with manufacturer guidelines.
These Terms & Conditions of Sale represent the entire and integrated agreement between the Customer and On The Sea and supersede all prior negotiations, representations, written or oral. In awareness of the relative benefits and risks associated with purchasing, handling, coordination, delivery, and installation of furnishings purchased at On The Sea, the Customer shall defend, indemnify, and hold harmless On The Sea and its associates, agents, employees, and consultants from all liability for any and all claims, costs, damages, losses, filing and court costs, attorneys’ fees, and expert-witness fees arising from any cause, to the fullest extent permitted by law. The Customer agrees that On The Sea shall be entitled to recover its reasonable attorneys’ fees and costs in any dispute arising out of payment or non-payment for products, services, fees, or costs arising out of On The Sea’s services and sale of merchandise.
By completing a purchase with On The Sea Interiors, you acknowledge that you have read, understood, and agree to these Terms & Conditions of Sale.
